Mediation, Arbitration and Special Master Services
Members of our firm regularly provide mediation services and act as arbitrators for all types of civil litigation. Much of the mediation work originates from a court order appointing our members to mediate a pending case, but many referrals are by agreement of counsel in the underlying dispute.
Our members who serve as arbitrators have undergone the training process of the American Arbitration Association and serve as panel members of AAA.
Service as a mediator or arbitrator gives our members a unique insight, which is particularly helpful when our clients are parties to mediation or arbitrate a dispute.
Members of the firm also serve as Special Masters, a position to which they are appointed by the court. Special Masters typically hear discovery disputes, although often substantive issues are also referred to the Special Master.
Special Masters make legal and factual recommendations to the judge before whom the case is pending. This, too, gives the lawyers of McDowell Knight a unique perspective on the decision process.
